Open Invention Network

My name is Frank Casey and I am writing to you on behalf of Open Invention
Network (OIN), an organization formed to support and protect the Linux
System and everyone who build or uses Linux related technology. I want to
take this opportunity to invite the KolibriOS team to join our community.

The OIN community helps support open innovation and deter patent
restriction around the Linux environment by providing an aggression "no fly
zone." Anyone can join by pledging nonaggression towards the other
community members and, in return, receives the same pledge from the others
as well as OIN's support if faced with aggression from third-parties. Our
goal is a future where patent aggression around Linux and its related
ecosystem is no longer acceptable.

There is no cost to join nor any other obligation. Today we have over 400
members from around the world who realized that patent issues pose a threat
to their freedom to innovate and wanted to support our efforts to keep
Linux open and free. Ubuntu, KDE, Gentoo, Mozilla, Hewlett-Packard, Cisco
Systems, and Google are a few of our members and we would be pleased to
have KolibriOS join too.

I hope you will give consideration to joining us and have attached for your
review a few items that speak to OIN. Also. if interested, you can go to

First of all, OIN can provide additional promoting. Then it can guarantee patents safety: all OIN members have cross-licenses for all their patents.

Mario, OIN is project of 400-500 companies such as IBM, Cisco, Canonical, Google, Mozilla and so on. This mail was forwared to me from Mike.dld, so I think this's because of ohloh.

Please wait for a while before acting, we all need to think first; some hidden rocks possible.
I suspect (not sure yet) this might turn some commercial customers out of Kolibri due to uncertain proptietary restrictions.

Why doesn’t Open Invention Network® just make all these patents available royalty-free to the entire public, or simply drop them?
We are making the patents available royalty-free, and all we ask in return is that the licensee agrees not to assert its patents against Linux.
I believe that they are all about Linux. So were will non compatible Kolibri will stick?

Kolibri got patents ready to go? OIN members saw the code and decided they can patent something? Just asking.

Some counries don't let software/codes be patented, but пиндосы do. And as the matter of fact, US s/w patents may be enforced everywhere. We obviously don't have patents in KolibriOS, but a lot of bright ideas might be easily included to 3rd party proprietary codes and protected by US law -- without our permission.

That is what we have now. Will the things go better (or worse) under OIN - who knows?

You make free soft in a free country (as a company not person) and you don't care if others get money for your ideas. First you extend your influence to the government of that country and then government extends influence to other countries. This is probably too ideal but this is the way to go.

Anyway if you join make sure OIN protects not only linux but Kolibri as well. And I very much doubt that.

Hello Dmitry,

Thank you for your note and questions.

1) US patents can only be enforced in the US and you can only get a patent
for what you created. There is a vigorous process in the US to show that
the one who is seeking a patent truly created the invention. The patent
examiners do a thorough search to find any "prior art" that would prove
otherwise.

2) The patent license you receive from OIN will cover anything that
KolibriOS makes, uses or sells. The license you receive from the other OIN
members would cover just the Linux System.

3) Again, you can only patent what you created; not what you saw.

Ответ на первый пункт это хуета. На Хабре рассматривалось - кто первый подал заявку тот и рулит, не важно кто потом изобретет и реализует технически. Примеры с Apple, Microsoft и прочими присутствуют. Остальные ответы вообще ни о чем. Я все еще не вижу никаких преимуществ от вступления в эту организацию - Koibri не дистрибутив Linux, а мистер ответивший не мыслит вне других категорий. Есть вероятность, что он просто выполняет план - собрать как можно больше проектов под крыло, чтобы было потом что предъявлять собственным инвесторам.

Ну допустим. Тут фишка в том что этих патентов у OIN ограниченое кол-во. Подавляющее кол-во патентов у IBM,Samsung,Microsoft ... ещё куча .... Я думаю вы сами понимаете. (Вдобавок, слово "anything" абсолютная фигня.)

А у разработчиков Kolibri есть деньги патентовать? Если нету то вам могут дать но заставят что нибуть подписать в обмен. Добро пожаловать в конкурентную капиталистическую семью.

Верно. А если не согласен то всегда можно опротестовать на нашем свободно шаре. Но надо денег. Много.

Допустим. Но тогда все немногочисленые патены которые лично OIN даёт действуют только в штатах. Ха ха.

А может OIN просто не готова защищать в других странах. Ну, знаете ... деньги дополнительные на это надо.
